Five Questions to Answer First

These are often different places or offices. Answer each one separately.

  1. Municipality of Arrest

The city, borough or township where the incident happened. It may differ from where the person lives.

  2. Arresting Agency

A local police department, the Pennsylvania State Police or another agency. The agency is not always named after the town.

  3. Detention Facility

Someone may be released, still in processing, at Chester County Prison, or held in another county or system.

  4. Court Jurisdiction

Most criminal cases start at a magisterial district court and may move to the Court of Common Pleas. The docket names the court.

  5. Bail Decision & Release

An issuing authority sets the bail terms. Release processing happens only after those terms are met and no other holds apply.

Magisterial District Courts

16 Offices Listed by the Court

Magisterial district judges hold preliminary arraignments, set and accept bail, issue arrest and search warrants, and hold preliminary hearings in misdemeanor and felony cases. They also handle traffic and other summary offenses, landlord-tenant cases and smaller civil claims.

The Court of Common Pleas oversees the magisterial district court offices in Chester County. The court named on the complaint or docket is the one that has the case, which is not always the closest office.

Court divisions are not the same as buildings, and district court assignments can change. Confirm the court, room and hearing date on the docket before traveling.

Need help understanding the bail process?

Get Bail Now
  1. Step 1: Arrest and Initial Processing

The arresting agency, such as a local police department or the Pennsylvania State Police, processes the arrest and files the charges.

The agency and the municipality of arrest are often different from where the person lives.

  2. Step 2: Preliminary Arraignment

The person goes before an issuing authority, usually a magisterial district judge, who explains the charges and makes the first bail decision.

Chester County's posted court plan lists preliminary arraignments and setting bail among the duties of its district judges.

  3. Step 3: Bail Determination

Release may be on recognizance, on nonmonetary or unsecured conditions, or on monetary bail; in limited cases bail may be denied.

When monetary bail is set, the order controls how it can be met. There is no universal amount or deposit.

  4. Step 4: Custody and Facility Verification

If the bail terms are not met right away, the person may be committed to Chester County Prison. The county's after-hours procedure says the bail paperwork goes with the person to the prison.

Call the prison at 610-344-5040 to confirm custody. Holds from other cases or counties are separate from bail on the new charge.

  5. Step 5: Posting Bail When Applicable

The county lists bail posting at the Clerk of Courts for Court of Common Pleas cases, 8:30 a.m. to 4:00 p.m. on weekdays. Outside those hours, bail may be posted at the prison after calling ahead; the county lists PAePay credit card payments and cash up to $9,500 there.

A commercial surety bond is a private agreement with a licensed bail bond company. The county says a professional bondsman must be licensed by the Pennsylvania Insurance Department and file that license with the Clerk of Courts. Get every fee and obligation in writing before you sign.

  6. Step 6: Release and Court Obligations

After bail is posted and no other holds apply, the prison completes release processing. No release time is guaranteed.

Every condition must be followed and every court date attended. A missed date can lead to a bench warrant and forfeiture of bail.

Cities, Boroughs & Townships

Chester County's 73 municipalities are one city (Coatesville), 15 boroughs and 57 townships. Each is its own local government; places such as Exton and Paoli are communities inside townships, not separate municipalities.

The municipality of arrest helps identify the local police department and the district court, but the paperwork controls. Two municipalities can share a name, like Honey Brook Borough and Honey Brook Township.
